What a distributor checks
Article 19 focuses the distributor on due care before making packaging available. The check includes whether the responsible EPR producer is registered, whether required labels are present, and whether the manufacturer and importer supplied their identifying information.
- Upstream supplier and manufacturer/importer identity
- Packaging or product reference
- Applicable producer-registration check
- Required label and operator markings
- Known complaints, restrictions or corrective actions
- Storage and transport conditions that preserve conformity
What to do when a check fails
Do not make the packaging available until the identified conformity or operator-information issue is resolved. Record what was found, who was contacted, what evidence came back and when the release decision was made.

Own-brand or modified packaging needs another look
A distributor that sells under its own name or trade mark or modifies packaging in a way that could affect compliance can take on manufacturer obligations under Article 21, subject to its micro-enterprise exception.
Country EPR responsibility also remains separate. A reseller can have a national registration action even where its EU conformity task remains verification.
